Consideration
In consideration for the rental rate agreed upon by the owner and guest,
the guest has a limited license to use the accommodation (hereafter
refered to as "premises") for the agreed upon term. Guest
acknowledges and agrees that no form of tenancy has been created
pursuant to Chapter 83, Florida Statutes through Guest’s use of the
Premises. Guest also agrees
to abide by the terms stated below.
General
No parties of guests who are all under the age of 21 will be accepted.
No pets accepted. For the comfort of guests our home is non-smoking,
however smoking is permitted on the patio area. Please use ashtrays
provided.
To ensure comfort, security and peace of mind our home
is registered with the State Authorities and is in full compliance
with all relevant legislation.
Check in and Check out Times
The premises is available for occupation
from 4:00 pm, local time on the day of your check-in.
Departure time - 10:30 am unless otherwise agreed upon
in writing.
Smoke Alarms Smoke alarms are situated around the entire villa. Do not tamper with
these devices. The cleaning crew checks all detectors upon guest checkout.
Telephone Calls All local telephone calls are free. All other outgoing calls require
a pre-paid phone card, available from any supermarket.
Linens and Towels All bed linen and towels are provided for your needs. Please bring
your own beach towels for use at the water parks.
Payment Details
A non-refundable booking deposit is charged for all reservations. This
deposit must be at least 25% of the total quoted amount or $150 -
whichever is greater. Full payment is required 10 days prior to arrival
for normal dates and
3 weeks prior for peak dates (Holidays, Summer, and Spring Break). The
booking deposit is applied to the total quoted amount.
We reserve the right to treat the booking as cancelled if we do not
receive the balance by the due date.
There are no refunds issued after full payment is made.
Price Guarantee
The price for renting the premises as stated at the time of booking
is fully guaranteed and no surcharges will be added to the costs
agreed upon.
Security/Breakages
The client is held responsible for any damage or breakages that may
be caused to the property its contents and also for any items in
the inventory during your stay. All damage and faults caused or found
at the home must be reported to us immediately.
We reserve the right to pursue a quest for recompense
for any and all damages within 14 days of being served notice of this.
Florida has a sub-tropical climate and care must be taken with food
that is left uncovered. Apart from spoiling, food left uncovered can
attract insects very quickly. Any added costs for pest control services
incurred from lack of care in this may be passed to you.
Safety and Security
Due to State Fire Regulations under no circumstances may more than
the maximum number of persons for this property which is eight (8)
guests.
Children must be supervised at ALL TIMES while at the clubhouse pool
area.
The owners reserve the right to enter the premises at any time for
whatever reason, but we will try to give notice whenever possible.
All doors and windows must be closed whenever you are
not in the property.
Pets
Animals/pets are strictly not permitted. If a pet has been in the property,
the guest must immediately pay a $300 cleaning/pest control fee or
leave the property immedately upon request without refund.
Computer & Internet
A computer and Broadband Internet connection is provided for guests
use. Please note that this service is provided FREE to guests. The
owners will use their best endeavours to ensure that the service
is available for use, but cannot be held responsible for any failures,
or non-availability, of communication lines, hardware or software.
When using the service you agree not to download or save any pornographic,
offensive, obscene or illegal material or to conduct any illegal
activity on the internet.
Documentation
All passports, visas and health certificate requirements are the clients'
responsibility. The owners and their agents accept no responsibility
for any delay or expense incurred through any irregularity in such
documents.
Liability
The owners and their agents do not accept liability whatsoever for
death, personal injury, accidents, loss or damage to persons or personal
effects however caused as a result of use of the premises. It
is your responsibility to ensure that children are always supervised
properly in and around the clubhouse pool and inside the premises.
Right to Refuse Occupancy and Removal of Guest
If
Guest violates the terms and conditions of occupancy of the Premises,
including
without limitation, failure to pay rent as agreed with Owner,
failure to check out of the Premises at the time set forth herein (or
if such time is extended at Owner's sole option, at the time
otherwise agreed to by Guest and Owner in writing), causing
damage to the Premises, or engaging in prohibited use of the Premises,
and Guest fails to pay for, or vacate the Premises upon written or
oral request by Owner, Guest may be summarily removed with
the assistance of a Florida law enforcement officer in compliance with
Section 509.141(4), Florida Statutes. In addition, in the case of a
large unpaid bill for rental of the Premises where Owner reasonably
determines that such an unpaid bill may not be paid by Guest, Owner
may elect, in addition to all other remedies available to Ownert,
to lock Guest out of the Premises until payment arrangements
are made in accordance with Section 509.401, Florida Statutes. In the
event a guest fail to depart from the home at on time at Check-Out
Time, forcing Owner not to be able to clean and prepare
the home
for the next arriving guest that day and having to move that guest
to another home, the departing guest agrees to pay damages and cost
incurred by Owner. Owner reserves the right to refuse
service to any guest for any reason, provided, however, that such refusal
shall not be based on race, creed, color, sex, physical disability
or national origin.
Force Majeure
The owners or their agents cannot accept responsibility, be responsible
or be liable in respect of damage or changes caused by Force Majeure,
e.g. strikes, floods, closure of airports, weather conditions or
other events beyond our control.
Unavoidable Changes
The owners and their agents reserve the right in any circumstances
to cancel the booking and in this event we will return all sums (but
without interest or compensation). In the event of a major change
to the booking being necessary, we will inform the client as soon
as reasonably possible, and if the client does not wish to accept
the booking on this basis we will cancel the booking and return all
sums (but without interest or compensation).
Booking Deposits and Balances In order to book a property, a deposit is required. This deposit
is credited toward the total stay. The amount of the deposit for any
booking is $150 or the greater part of 25% of the total rent amount.
Balances must be paid as follows:
10 or more days or prior to arrival date - Standard Bookings
14 or more days or prior to arrival date - Bookings totalling
more than $650.00.
3 or more weeks prior to arrival date, Peak bookings (Holidays, Spring,
and Summer).
Cancellation
In the event of your needing to cancel the following fees will apply:
10 or less days prior to arrival date - 100% of the
rent.
14 or less days prior to arrival date - 100% of the rent for bookings
totalling more than $650.00.
3 or less weeks prior to arrival date, 100% of the rent for peak
bookings (Holidays, Spring,
and Summer).
In no case is the booking deposit refunded.
Other Please ensure you have adequate Travel Insurance to cover your losses
if cancellation is due to an insured event beyond your control resulting
in a financial loss.
We want our home to remain as clean and tidy for each and every visitor,
so please respect our home and treat it with the care it deserves.
By booking the premises you agree to the above policies,
which become a contract between you and the owner.
